Please read this Risk Disclosure carefully before purchasing a Challenge or Instant Funding product from Empire Funding Limited. By purchasing, you acknowledge that you have read and understood this disclosure.

1. Not a Brokerage, Not Investment Advice

Empire Funding Limited is not a licensed or regulated broker-dealer, investment adviser, or financial services provider in any jurisdiction, including Hong Kong (SFC), the United States (CFTC/NFA/SEC), the United Kingdom (FCA), the European Union (national regulators/ESMA), or Australia (ASIC). We do not accept client deposits for live trading, do not hold client funds, and do not provide investment advice, portfolio management, or any recommendation to buy, sell, or hold any financial instrument. Nothing on this Site, in our marketing materials, or in affiliate promotions constitutes financial advice.

2. Simulated Trading Environment

All Challenge accounts and all Funded Accounts offered by Empire Funding are simulated/demo trading environments. No live orders are placed in any real financial market on your behalf at any point in the Challenge or Funded Account process. Empire Funding tracks your simulated trading performance against published rules and, where applicable, pays a Profit Split from its own revenue based on that simulated performance. This structure is the same general model used by other firms in the proprietary trading evaluation industry.

3. Nature of the Product

Participation in a Challenge or Instant Funding evaluation is a skill-based, paid evaluation service. It is not a security, derivative, deposit, or investment product, and it does not constitute a regulated financial activity in any jurisdiction in which Empire Funding has assessed its offering. You are responsible for determining whether participation is lawful in your own jurisdiction before purchasing.

4. The Fee You Pay Is At Risk

Challenge and Instant Funding fees are paid up front and are, except as described in our Refund Policy, non-refundable. There is a substantial risk that you will not meet the trading objectives required to qualify for or retain a Funded Account, in which case the fee paid is forfeited.

5. Most Participants Do Not Pass or Get Paid

Based on patterns observed broadly across the proprietary trading evaluation industry, the majority of participants who purchase a Challenge do not successfully complete the evaluation criteria, and among those who do reach a Funded Account, not all go on to receive a payout, due to subsequent breach of trading rules or other disqualifying conduct. Empire Funding encourages you to treat the Challenge fee as a cost of participation that may not be recovered, not as an investment with an expected return.

6. No Guarantee of Profit or Funding

Nothing in our marketing, social media content, or affiliate promotions guarantees that you will pass a Challenge, qualify for a Funded Account, or receive any specific level of profit or payout. Results referenced anywhere on the Site, including statistics about other participants, are not indicative of, and do not guarantee, your own results.

7. Trading Rules and Disqualification Risk

Funded status and continued access to a Trading Account depend on continuous compliance with published trading rules, including maximum daily loss, maximum overall drawdown, minimum trading days, and consistency requirements. Breach of any applicable rule, even unintentionally, results in disqualification and forfeiture of the account, without entitlement to any pending or future Profit Split on that account.

8. Platform and Technology Risk

Trading Accounts operate on the TradeLocker platform. Empire Funding is not responsible for outages, data feed delays, execution simulation limitations, or other technical issues that may affect your evaluation or Funded Account performance.

9. Payout Risk

Any Profit Split is paid from Empire Funding's own revenue and is subject to internal verification, including KYC/AML review and confirmation that no trading rule was breached. A pending payout is not a guaranteed entitlement until this verification is complete.

10. Jurisdictional Responsibility

You are solely responsible for ensuring that your use of the Services complies with the laws applicable to you, including any restrictions on participation in skill-based or trading-evaluation products in your country or region. Empire Funding may restrict access from certain jurisdictions at its discretion.

11. Acknowledgment

By completing a purchase, you confirm that you have read, understood, and accepted this Risk Disclosure, and that you understand the simulated nature of the Services and the risk that you may not recover the fee paid.
